Summary of appeal published on 17 October 2011. A case management conference took place on 7 November 2011. A hearing to consider the OFT’s application for disclosure took place on 8 March 2012. The Tribunal’s judgment on that application was handed down on 20 March 2012. On 23 March 2012 the Chairman made an order in relation to the sequence of opening submissions and allocation of time for cross-examination at the main hearing.

On 20 April 2012 the Chairman directed that the Appellant, if so advised, file and serve a witness summary from each relevant witness setting out those issues which, they say, are new points arising from the Respondent’s skeleton argument and supporting evidence, and summarising what additional evidence, if any, the witness intends to give on those issues. The main hearing took place between 26 April 2012 and 31 May 2012. A further hearing to hear Tesco’s oral reply submissions took place on 13 July 2012. The Tribunal’s Judgment on liability was handed down on 20 December 2012.

On 28 January 2013, the Chairman of the Tribunal made an Order disposing of the liability phase of the appeal following the Tribunal’s judgment on liability ([2012] CAT 31). On 26 February 2013, the Chairman made a Consent Order pursuant to Rule 57 of the Tribunal Rules, disposing of the outstanding issues in the appeal, varying the financial penalty imposed on the Appellants and vacating the further hearing fixed by the Order of 28 January 2013.
