Ruling of the Tribunal refusing the Secretary of State’s request for permission to appeal from the Tribunal’s judgment of 10 December 2008 ( CAT 36).
The Secretary of State requested permission to appeal against the Tribunal’s finding that the Applicants had standing to bring an application for review under section 120(1) of the Act.
The Tribunal refused permission to appeal on the basis that the ground of appeal did not disclose a point of law. In any event, the Tribunal held that the point had no real prospect of success and there were no other compelling reasons to allow an appeal to the Court of Session.
