Claim under section 47A of the Competition Act 1998 for damages and an injunction.
A hearing took place remotely on 21 January 2021 in respect of the Claimants' application to serve the First and Second Defendants out of the jurisdiction. By a judgment dated 22 February 2021 ([2021] CAT 4), the Tribunal granted permission to the Claimants to serve out of the jurisdiction.
The first case management conference ("CMC") in these proceedings took place in-person on 6 December 2021. The second CMC in these proceedings took place in-person on 25 May 2022.
The third CMC in these proceedings took place on 25 March 2024, to consider the Claimants' application for the joint case management and trial of these proceedings (the "Epic Proceedings") with case 1408/7/7/21 (the "Coll Proceedings"). Following the CMC, the Tribunal made an Order dated 15 May 2024 regarding the part consolidation of the Epic and Coll Proceedings. Accordingly, the trial originally listed to commence on 5 May 2025 has been adjourned and the Epic Proceedings are to be tried as set out in paragraph 9 of that Order.
A further CMC took place on 10 November 2024.
A further CMC took place on 5 December 2024.
On 14 March 2025, a joint CMC took place to consider consolidation of the Rodger Proceedings (Case 1673/7/7/24) with these proceedings and the Coll Proceedings (Case 1408/7/7/21). By Order dated 24 March 2025, the Tribunal ordered the joint case management of the Epic, Coll and Rodger Proceedings. On 30 April 2025, the Tribunal issued its judgment in relation to joint case management ([2025] CAT 25).
A further joint CMC with the Coll and Rodger Proceedings took place on 23 June 2025 and 15 July 2025 to consider disclosure issues.
A further Joint CMC with the Coll and Rodger Proceedings took place on 1 August 2025. The Tribunal's ruling in relation to expert evidence is pending.
A further Joint CMC with the Coll and Rodger Proceedings has been listed to take place on 25 September 2025 to consider supplemental disclosure requests, before Hodge Malek KC sitting alone.
