Ruling of the Chair on the application of OT Computers Limited ("OTC") for additional disclosure from Samsung Semiconductor Europe Limited ("SSEL"). OTC sought disclosure of: (i) certain documents held by SSEL's solicitors; and (ii) data recorded on management and/or accounting systems of other named companies in the Samsung group of companies.
The Chair ordered that SSEL must carry out reasonable and proportionate searches of documents held by its solicitors in so far as those documents comprise documents of SSEL itself, or documents filed jointly by SSEL and the named companies in the Samsung group. The application was otherwise refused.
