A ruling of the Tribunal on the parties’ costs applications following its judgment granting a collective proceedings order [2026] CAT 75. The Tribunal made no order as to costs, finding that no party could be regarded as wholly or even predominantly successful in relation to the certification application and that any attempt to allocate costs between individual issues would involve a high degree of subjectivity, with the various issues being more closely interwoven than would be fairly reflected in a straightforward division of the total costs.
