An application by Dr Liza Lovdahl Gormsen to commence collective proceedings under section 47B of the Competition Act 1998 (“the Act”) against (1) Meta Platforms, Inc. (2) Meta Platforms Ireland Limited and (3) Facebook UK Limited for loss and damage caused by alleged breaches of statutory duty by infringing Article 102 of the Treaty on the Functioning of the European Union and section 18 of the Act, which prohibit the abuse of a dominant position in a market (“the Claims”) (the "CPO Application"). The Claims cover the period from 11 February 2016 to 31 December 2019.
The case management conference ("CMC") listed for 26 September 2022 was vacated.
The hearing of the CPO Application took place from 30 January 2023 to 1 February 2023. Judgment was issued on 20 February 2023 ([2023] CAT 10).
The Tribunal made a Reasoned Order on 22 March 2023 regarding costs, and staying proceedings for six months from the date of the Order.
A hearing took place on 8 to 9 January 2024 to consider the CPO Application. Judgment was handed down on 15 February 2024 ([2024] CAT 11).
The Proposed Defendants applied for permission to appeal [2024] CAT 11 on 7 March 2024. The Tribunal refused that application on 29 April 2024.
A CMC took place on 16 December 2024.
A further CMC took place on 4 April 2025, to consider the future conduct of the proceedings.
A further CMC took place on 15 and 16 July 2025, to consider issues related to disclosure. The CMC was Chaired by Hodge Malek KC.
A hearing took place on 29 September 2025 to consider the Class Representative's application to amend her collective proceedings claim form. On 30 September 2025, the Tribunal issued its ruling in relation to the amendment application ([2025] CAT 55). By Reasoned Order dated 23 October 2025, the Tribunal refused the Defendants' application for permission to appeal the ruling in relation to the amendment application.
A further CMC took place on 24 and 26 November 2025, to consider issues related to disclosure.
