An application by Clare Mary Joan Spottiswoode CBE to commence collective proceedings under section 47B of the Competition Act 1998 ("the Act") against: (1) Nexans France S.A.S.; (2) Nexans S.A.; (3) NKT A/S (formerly NKT Holdings A/S); (4) NKT Verwaltungs GmbH; (5) Prysmian Cavi E Sistemi S.r.l.; and (6) Prysmian S.p.A. (together "the Respondents/Proposed Defendants") for loss and damage caused by alleged breaches of statutory duty by infringing Article 101 of the Treaty on the Functioning of the European Union and Article 53 of the Agreement on the European Economic Area, as determined by the European Commission in its infringement decision dated 2 April 2014 in Case AT.39610 Power Cables.
A case management conference took place on 26 June 2023 at which the President made case management directions, including the listing of the certification hearing.
The certification hearing took place on 11 April 2024. On the 3 May 2024 the Tribunal issued its certification judgment ([2024] CAT 31) and the Collective Proceedings Order was drawn on the same date.
A joint CMC with case 1518 took place on 22 May 2024. Pursuant to the Order of the Tribunal subsequent to that hearing, the trial of the ROC Issue shall take place 19 - 23 May and 3 - 6 June 2025, which shall be attended by the parties to these proceedings and case 1518.
A further joint case management conference with case 1518 listed to take place on 30 July 2024 was vacated.
A pre-trial review took place on 21 March 2025.
The joint trial of the ROC Issues, with the London Array Proceedings (Case 1518/5/7/22), took place between 20-23 May 2025 and 3-5 June 2025. On 30 October 2025, the Tribunal issued its judgment in relation to the ROC Issues ([2025] CAT 68). A ruling in respect of the costs of the ROC Issues was delivered on 3 March 2026.
A case management conference was held on 23 March 2026.
On 10 April 2026 the Tribunal issued its Ruling on an application by the Defendants for permission to rely on expert economic evidence in relation to certain issues in the parties’ draft agreed list of issues for trial ([2026] CAT 31).
On 1 May 2026, the Tribunal issued a Ruling ([2026] CAT 40) refusing the Defendants' application for Wider ROC Costs.
A further case management conference has been listed to take place on 13 July 2026, with a time estimate of one day with one day in reserve.
