Status
The Proposed Class Representative ("PCR) seeks to commence opt-out collective proceedings under section 47B of the Competition Act 1998 (the “Act”) . The “PCR” seeks to combine claims for loss and damage caused by breach of statutory duty by companies within the Amazon corporate group ((1) Amazon.com Inc.; (2) Amazon Europe Core S.à.r.l.; (3) Amazon Services Europe S.à.r.l. (4) (3) Amazon EU S.à.r.l.; (5) (4) Amazon UK Services Ltd; and (6) (5) Amazon Payments UK Limited), and in particular by infringements of Article 102 of the Treaty on the Functioning of the European Union (up to 31 December 2020) and Section 18 of the Act.
By order of the Chair, the Third Proposed Defendant was removed on 27 September 2024 as a party to the proceedings upon the merger of the Third Proposed Defendant with the Fourth Proposed Defendant on 1 August 2024.
A hearing to determine whether Professor Andreas Stephan of BIRA Trading Limited (in Case 1641/7/7/24) is the more suitable class representative to have carriage over the proposed claims was held on 11, 12 and 13 November 2024. Judgment determining the carriage dispute was handed down on 20 January 2025.
A joint certification hearing with case 1595/7/7/23 took place on 6 - 8 May 2025. The Tribunal issued a Judgment on certification on 24 July 2025 ([2025] CAT 42).
On 14 August 2025, the Defendants' sought permission to appeal the certification judgment, which was refused by the Tribunal. The application was renewed before the Court of Appeal, who also refused to grant permission to appeal by a decision dated 26 February 2026 [2026] EWCA Civ 183.
On 2 June 2026, a CMC was held jointly with case 1595/7/7/23.
A further hearing is listed to take place on 7 September 2026, with a day in reserve on 8 September 2026, to address the Defendants' Opt-In Application.
A further CMC is listed to take place jointly with case 1595/7/7/23 on 14 October 2026, with a day in reserve on 15 October 2026.
A First Stage Trial has been listed to commence on 25 April 2028, with a provisional time estimate of 8 weeks.
