Claim for damages and injunctive relief under section 47A of the Competition Act 1998 brought by (1) Mr Graham Thomas; (2) BEK Developments Ltd; (3) Alleyhaus Ltd; (4) Dales and Moors Developments Ltd; and (5) Masonic Hall Ltd (the “Claimants”) against Durham County Council (the “Defendant”).
A hearing to consider the Claimants' application to amend their claim form and the Defendant's application to strike out proceedings was listed for 25 March 2026, with a time estimate of one day. The hearing was adjourned and then took place on 15 April 2026. In the hearing, the claim was struck out. Reasons followed in a judgment handed down on 5 June 2026 ([2026] CAT 47).
