An application made under section 70 of the Subsidy Control Act 2022 ("SCA22") by Zenobē Energy Limited (the “Applicant” or “Zenobē” ). The application relates to a decision of the Gas and Electricity Markets Authority (“GEMA” or the “Respondent”) to make a subsidy scheme in respect of longer-duration energy storage projects. It is alleged that establishment of the scheme constitutes a subsidy decision within the meaning of SCA22, that the scheme was not validly made and that is should be quashed.
