This is the Tribunal's judgment allowing Google's application to strike out paragraphs of Foundem's particulars of claim concerning its "OneBox Claim".
Foundem had made certain amendments to its particulars of claim on 14 November 2024 and 20 August 2025 regarding Google's use of the Product OneBox in the period between 2006 and 2008. The amendments broadly alleged that Google had used the Product OneBox to promote its own comparison shopping services on its search engine results page and that this constituted an abuse of its dominant position.
The Tribunal found that the amendments comprising the OneBox Claim constituted a new claim that did not arise out of the same or substantially the same facts as the claim originally pleaded. The OneBox Claim was therefore time-barred under the relevant limitation rules.
