The Tribunal refused permission for the Green British Foundation (“GBF”) to intervene in the collective proceedings order (“CPO”) application filed by the proposed class representative.
The Tribunal determined that GBF had not demonstrated sufficient interest in the CPO application and that its intervention would not assist the Tribunal in determining the application.
The matters raised in GBF’s intervention application were either irrelevant or tangential to the issues to be determined in the proceedings. The Tribunal therefore concluded that permitting the intervention would be inconsistent with the Tribunal’s governing principles under Rule 4 of the Tribunal Rules, in particular Rule 4(2)(b) and (e).
