The Tribunal's reasoned order on costs following the Tribunal's Ruling on Costs ([2026] CAT 25), which itself followed the Tribunal's judgment dated 27 August 2025 refusing to grant a collective proceedings order, granting reverse summary judgment, and striking out the Proposed Class Representative's claim ([2025] CAT 49). The Tribunal noted that the appropriate starting point for costs of costs applications is that they are treated as costs of the action. In light of the Proposed Class Representative's success in reducing the overall costs award and the offer of a payment on account, the Tribunal considered that it was appropriate to make no order as to costs.
