Judgment of the Court of Appeal dismissing Meta's appeal to the Tribunal's judgment in [2025] CAT 55.
The Court of Appeal found that the Tribunal was correct to grant the class representative permission to amend its case to include a claim for user damages. The Court found that a remedy of user damages may be be available in competition law to compensate for the unlawful extraction of data in the context of the abuse of dominance claim in these proceedings. The Court found that the Tribunal was correct to allow this issue to go to trial.
