Claim under section 47A of the Competition Act 1998 (the “Act”) for damages and an injunction arising from an alleged infringement of the Chapter I and/or Chapter II prohibitions in the Act. The Claimants have applied for fast-track designation of the proceedings and an interim injunction.
Pursuant to a consent order agreed between the parties, the hearing of the interim injunction application, which had been listed for 17 October 2016 before Mrs Justice Rose, was vacated. The proceedings were stayed until 23 December 2016 pursuant to the Orders of the Chairman made on 11 November 2016 and 19 December 2016 to allow the parties to engage in settlement discussions by way of mediation.
Upon the parties having agreed terms of settlement, the proceedings were stayed by a consent order made on 18 January 2017.
