1354/4/12/20 JD Sports Fashion plc v Competition and Markets Authority

On 2 June 2020 the Tribunal made an order extending time for JD Sports Fashion plc to file a notice of application by reason of the exceptional circumstances arising from the Covid-19 pandemic.

Summary of application was published on 23 June 2020. By order of the Chairman of the same date, the time for filing any requests for permission to intervene was abridged until 5pm on 1 July 2020. A case management conference took place on 6 July 2020 as a remote case event. The Tribunal gave directions for the future conduct of the application and refused a request for permission to intervene by Frasers Group plc. On 10 July 2020 the Tribunal issued a Ruling setting out its reasons for refusing the intervention request ([2020] CAT 17). On 21 August 2020 the Chairman issued a Ruling on JD Sports' application for specific disclosure ([2020] CAT 20).

The main hearing of the application took place on 23 and 24 September 2020. Judgment was issued on 13 November 2020.

On 17 December 2020, the Tribunal issued a ruling refusing the CMA's application for permission to appeal ([2020] CAT 27).
