1527/7/7/22 Alex Neill Class Representative Limited v Sony Interactive Entertainment Europe Limited; Sony Interactive Entertainment Network Europe Limited; and Sony Interactive Entertainment UK Limited

An application to commence opt-out collective proceedings, under section 47B of the Competition Act 1998 by Alex Neill Class Representative Limited against (1) Sony Interactive Entertainment Europe Limited; (2) Sony Interactive Entertainment Network Europe Limited; and (3) Sony Interactive Entertainment UK Limited (the “Proposed Defendants”). The proposed collective proceedings would combine standalone claims against the Proposed Defendants for loss and damage caused by alleged breaches of statutory duty in infringing the Chapter II Prohibition and/or Article 102 of the Treaty on the Functioning of the European Union.

A CMC took place on 14 December 2022.

The hearing of the CPO Application, including any strike-out/summary judgment application, has been listed for 7 June 2023 with a time estimate of three days.

On 30 May 2023, an Order of the Chair granted permission to the Proposed Class Representative to amend its Reply and Response to the Strike Out / Reverse Summary Judgment Application of the Proposed Defendants.

The CPO Application hearing took place on 7 to 9 of June 2023. A further hearing in relation to funding took place on 9 October 2023. Judgment was issued on 21 November 2023 ([2023] CAT 73). The Collective Proceedings Order was made on 19 January 2024.

A CMC has been listed to take place on 14 June 2024.
