A Claim made pursuant to section 47A of the Competition Act 1998, by Mr Patrick Henry McAuley (the “Claimant”) against the Faculty of Advocates Services Ltd (the “Defendant”). According to the Claim, the Claimant requested that the Defendant provide advocacy services in relation to two cases in which the Claimant is acting as a self-represented solicitor. The Claim alleges that the Defendant refused to provide advocacy services and instructed all advocates within the faculty not to provide services to the Claimant. The Claim arises from alleged infringements of the prohibitions contained in section 2 (the “Chapter I Prohibition”) and section 18 (the “Chapter II Prohibition”) of the Competition Act 1998.
On 11 March 2025 the Acting President gave a ruling on the constitution of the Tribunal panel appointed to hear this case.
A case management conference ('CMC') is listed to take place in Court 1 in the Court of Session in Edinburgh on 29 April 2025, with a time estimate of half a day, starting at 11am.
