1746/5/7/25 (T) The Secretary of State for Health and Social Care & Another v Servier Laboratories & Others

Claim for damages brought by the Secretary of State for Health and Social Care and the NHS Business Services Authority, in respect of alleged infringements of prohibitions imposed by Articles 101 and 102 of the Treaty on the Functioning of the European Union, and/or Chapters I and II of the Competition Act 1998.

The claim is made against (1) Servier Laboratories Limited; (2) Servier Research And Development Limited; (3) Les Laboratoires Servier SAS; and (4) Servier SAS. The Defendants have made additional claims against the following Third Parties: (1) Niche Generics Limited; (2) Unichem Laboratories Limited; (3) Mylan Laboratories Limited; (4) Viatris Inc.; (5) Krka, Tovarna Zdravil, D.D. Novo Mesto; (6) Teva UK Limited; (7) Teva Pharmaceuticals Europe B.V.; (8) Teva Pharmaceuticals Industries Ltd; and (9) Lupin Limited.

The proceedings were transferred from the High Court to the Tribunal by order of the Honourable Mr Justice Roth dated 9 June 2025.
