The Court of Appeal found that the Tribunal was right to find that there was no material conflict of interest between the defendant groups. It made no error of law in reaching that conclusion and there was nothing further to take into account in considering the justice of the case beyond the reasons identified by the Tribunal for having a single joint expert from the defendant groups. The appeal was therefore dismissed.
