Judgment of the Tribunal: (i) further to Google's application to renew its strike out application in respect of the claims of the Class Representative which relate to losses arising before 1 October 2015; and (ii) as to whether to provide for the simultaneous or sequential exchange of expert reports. The Tribunal concluded in respect of (i) that, although it is not open to the Tribunal to change its mind in respect of a case management decision unless there has been a material change in circumstances, that material change had occurred in the form of the clarification in the law in Umbrella Interchange Fee Claimants v Umbrella Interchange Fee Defendants [2024] EWCA Civ 1559, [2025] 2 All ER 1009. In respect of (ii), it was concluded that a sequential timeline for the exchange of expert reports was appropriate as it would better serve the Tribunal.
