Ruling of the Tribunal in relation to expert evidence and other case management issues, following the case management conference held on 18 December 2025.
An Order will accompany this Ruling, which sets out, in particular, the timetable for: (i) the provision of further particulars relating to the list of issues for expert evidence; (ii) the Class Representative making an application for permission to adduce evidence from a trade witness; and (iii) the process by which the Class Representative is to conduct a survey.
The ruling, also reflected in the Order, also amends and gives further directions to trial and requires the parties to seek to agree wording to exclude mailing houses and mail consolidators from the class definition.
