Judgment of the Acting President refusing an application by Mr Lyons for an extension of time within which to appeal three decisions of the former (now defunct) Phone-paid Services Authority (PSA), which decisions were taken in 2018, 2019, and 2020.
The Acting President held that Mr Lyons had shown no exceptional circumstances under Rule 9(2) of the Competition Appeal Tribunal Rules 2015 justifying the granting of the extension of time.
On the basis of this finding, the Acting President further held that there it was unnecessary to reach a conclusion on: (i) whether Mr Lyons had standing to appeal the first two impugned decisions on the basis that he was not an addressee thereof; and (ii) whether the Tribunal has jurisdiction to hear appeals against decisions of the PSA. With regard to (ii), Mr Lyons had argued that because the relevant regulatory function of the PSA under which the three decisions were taken had been transferred to Ofcom by Order as of 1 February 2025, the Tribunal had jurisdiction to hear his appeals. Ofcom argued that the Tribunal had no jurisdiction to hear the appeals.
