Decision of the Tribunal on ACSO's application for a collective proceedings order (CPO). The Tribunal indicated that it would be prepared to authorise ACSO as the class representative, subject to:
(i) reducing ACSO's fee to £150/hour, capped at £750 per day;
(ii) amending the litigation budget to reflect the terms of the ruling; and
(iii) making two amendments to the litigation funding agreement.
The Tribunal also found that the eligibility condition would be satisfied, subject to conditions addressing the management of overlap between these proceedings and those in Cases 1595 and 1644.
ACSO was directed to inform the Tribunal within four weeks whether it intends to pursue its CPO application on that amended basis.
