1537/5/7/22 (T) OT Computers Limited (in liquidation) v Micron Europe Limited

Claim for damages for breaches of Articles 101 of the Treaty on the Functioning of the European Union and/or Article 53 of the Agreement on the European Economic Area and/or section 2 of the Competition Act 1998 brought by OT Computers Limited against Micron Europe Limited. The Claimant relies on the decision of the European Commission dated 19 May 2010 (Case COMP/38511 DRAMs).

The claim was transferred from the High Court to the Tribunal by order of the Honourable Mr Justice Foxton dated 5 October 2022.

A case management conference took place on 13 June 2023, following which the Tribunal gave directions for the future conduct of the proceedings and as set out in an Order drawn on 30 June 2023 ('CMC Order'). On 30 June 2023, the Tribunal made a Confidentiality Ring Order and an Order granting disclosure of the European Commission file to the Claimant.

A second CMC took place on 28 November 2023. On 29 December 2023, the Tribunal issued its Ruling in relation to the Micron Defendant's Security for Costs application ([2023] CAT 77) and the applications from the parties for further disclosure ([2023] CAT 78). 

By Order dated 25 June 2024, the Claimant's claims against the Defendant were stayed. By Order dated 20 August 2024, the stay was lifted and the Part 20 Claimant assigned its claim to OT Computers Limited (In Liquidation). By Order dated 23 December 2024, directions to the third case management conference were set out. The third case management conference was held on 21 February 2025.

By Ruling dated 20 August 2025, the Claimant's disclosure application was refused.

By Reasoned Order dated 24 November 2025, the Part 20 Claim was ordered to be subject too costs management. A CMC was listed for hearing on 6 March 2026.

The CMC was vacated and the Part 20 Claim dismissed by consent by order made on 4 March 20256
