Summary of appeal published on 18 December 2017.  

On 16 January 2018 the President made an Order granting Inmarsat Ventures Limited permission to intervene. The President made a further Order on 24 January 2018 establishing an interim confidentiality ring in these proceedings (the “Interim Confidentiality Ring Order”).  

A case management conference took place on 14 February 2018 at which the Chairman: (i)  made an ex tempore ruling on confidentiality;  (ii) made an order amending the Interim Confidentiality Ring Order; and (iii) gave various case management directions. 

A pre-trial review took place on 12 June 2018.  

The main hearing of the appeal took place over four days namely 26, 27, 28 June and 3 July 2018 (inclusive). Judgment was handed down on 7 December 2018.

On 12 December 2018, the Chairman made an Order extending time for filing any applications for permission to appeal the Judgment. 

A hearing took place on 15 April 2019 at which the Tribunal gave an ex tempore ruling: (i) refusing Viasat's application for permission to appeal the Tribunal's substantive Judgment; and (ii) granting Inmarsat's application for its costs of the proceedings.  A renewed application for permission to appeal was subsequently granted by the Court of Appeal. 

The appeal was heard by the Court of Appeal on 10 March 2020. On 11 May 2020 the Court of Appeal handed down its judgment dismissing the appeal ([2020] EWCA Civ 624).
