1341/5/7/20 (T) SP Power Systems Limited and Others v Prysmian S.p.A and Others

Claim for damages for breach of Article 101 of the Treaty on the Functioning of the European Union by (1) SP Power Systems Limited; (2) Scottish Power UK Plc; (3) Scottish Power Energy Networks Holdings Limited; (4) SP Manweb Plc; and (5) SP Transmission Plc (the “Claimants”) against (1) Prysmian SpA; (2) Prysmian Construction Company Limited; (3) Prysmian Cables & Systems Limited; (4) Prysmian Cavi e Sistemi S.r.l.; and (5) Prysmian Cables (2000) Limited. The Claimants rely on a decision of the European Commission of 2 April 2014 in Case AT/39610 – Power Cables which was addressed to (amongst others) the First and Fourth Defendants.  

The issues in the proceedings were transferred from the High Court to the Tribunal by order of the Chancellor dated 28 February 2020.

Pursuant to a consent order dated 30 July 2020, the proceedings have been stayed upon the terms set out in a confidential agreement between the parties.

By an order of the Chairman dated 7 January 2022, the Prysmian Defendants' Part 20 claim against Goldman Sachs is stayed.
