1603/7/7/23 Professor Carolyn Roberts v (1) Severn Trent Water Limited and (2) Severn Trent PLC

The Proposed Class Representative (PCR) contends that the Proposed Defendants (PDs) have committed, and continue to commit, abuses of a dominant position, in breach of section 18 of the Competition Act 1998, in providing misleading information to the relevant regulatory bodies, the Environment Agency and the Water Services Regulation Authority (Ofwat). The PCR alleges that the effect of this conduct has been to cause Ofwat to allow the PDs to charge its customers higher prices for sewerage services than it would otherwise have been permitted to charge.

A joint CMC in the Water CPO cases (Cases 1603/7/7/23, 1628/7/7/23, 1629/7/7/23, 1630/7/7/23 and 1631/7/7/23) took place on 19 March 2024. At the CMC the Tribunal gave on a Ruling on the future conduct of the proceedings.

The CPO application hearing took place on 23-25 September 2024. Judgment is pending.
