Application for a collective proceedings order arising out of Microsoft's allegedly unlawful licensing practices relating to the software known as "Windows Server" and cloud computing services. The application is made on behalf of a proposed class of UK domiciled organisations which obtained a licence to use Windows Server from listed providers, which it is alleged have been harmed by Microsoft's conduct. The claims it is proposed to combine in the collective proceedings are for damages resulting from Microsoft's alleged breaches of section 18 of the Act and/or Article 102 of the Treaty on the Functioning of the European Union.
A case management conference was listed on 10 June 2025 but was vacated by consent. The parties agreed directions to the CPO Hearing, which has now been listed for 11 December 2025 (with one day in reserve).
