Application for a collective proceedings order arising out of Motorola charging allegedly excessive and unfair prices for the provision of Airwave Services. The claims arise out of alleged breaches of competition law which are closely analogous to the findings in a market investigation conducted by the Competition and Markets Authority which found that there were behavioural and structural features of the relevant market giving rise to an adverse effect on competition. The claims it is proposed to combine in the proposed collective proceedings are for damages resulting from Motorola's alleged breaches of section 18 of the Act.

A CMC was listed for 15 May 2025, but vacated following agreement between the parties on directions for the CPO Hearing.

A CPO Hearing was held on 12 & 15 September 2025. The Tribunal issued its judgment in respect of the CPO application on 13 October 2025 ([2025] CAT 60).

A CMC was held on 4 March 2026 with a time estimate of one day. A CMC has been listed for the 23 September 2026 with a time estimate of up to two days.

A split trial has been ordered in the proceedings, as between a hearing on all matters excluding issues relating to pass-on and one trial on issues relating to pass-on. The first of these is listed for a period of six weeks in October 2027.
