A counterclaim for damages brought by Whaleco UK Limited against (1) Roadget Business Pte. Ltd and Shein Distribution UK limited in respect of alleged infringements of prohibitions imposed by Chapters I and/or II of the Competition Act 1998.
The competition issues were transferred from the High Court to the Tribunal by order of Mrs Justice Bacon dated 29 July 2025.
Case management conferences took place on 23 September and 17 December 2025.
The trial to determine competition liability, causation and declarative and injunctive relief in the proceedings has been listed for a period of three and a half weeks including three days of pre-reading commencing on 25 November 2026.
A case management conference has been listed on 9 January 2026 in respect of these proceedings and the concurrent High Court intellectual property proceedings. The case management conference will take place in the Tribunal before the President.
