An application made under section 70 of the Subsidy Control Act 2022 ("SCA22") by Zenobē Energy Limited (the “Applicant” or “Zenobē” ). The application relates to a decision of the Gas and Electricity Markets Authority (“GEMA” or the “Respondent”) to make a subsidy scheme in respect of longer-duration energy storage projects. It is alleged that establishment of the scheme constitutes a subsidy decision within the meaning of SCA22, that the scheme was not validly made and that is should be quashed.
This application is being jointly case managed with the related Tribunal case 1754/12/13/25.
The appeal was heard on 28-29 April 2026. On 23 June 2026, the Tribunal delivered its Judgment [2026] CAT 53 dismissing the applications for review in both cases 1754/12/13/25 and 1769/12/13/26.
