Claim under section 47A of the Competition Act 1998.

A case management conference (CMC) was listed for 27 October 2020 and took place as a remote case event.  The Chairman gave a ruling at the CMC on the Claimants' application for a split trial and early disclosure ([2020] CAT 22) and gave directions for the future conduct of the proceedings.

A second CMC took place on 12 January 2021 as a remote case event and the Chairman gave further directions.

The Defendants made an application on 8 July 2021 requesting further information and clarification from the Claimants ("RFI Application") and an application on 19 July 2021 for disclosure ("Disclosure Application").  The hearing of the Defendants' RFI and Disclosure Applications took place on 8 September 2021 where the Chairman gave directions.

On 17 August 2021, the Defendants made an application to vary paragraph 5(c) of the Tribunal's Order made on 12 January 2021 in respect of costs management ("Costs Management Application"). The hearing of the Defendants' Costs Management Application listed for 8 September 2021 was adjourned and took place on 22 October 2021.

On 30 September 2021, the Defendants made an application to strike out certain allegations contained in the Claimants' witness evidence ("New Allegations Application").  The New Allegations Application was determined on the papers and the Chairman made an order on 30 November 2021.

A Pre-Trial Review took place on 13 December 2021.

The hearing for the First Trial took place on 24 January to 2 February 2022, and the hearing for oral closings took place on 13 and 14 April 2022. On 15 July 2022, the Tribunal issued its judgment dismissing the claim ([2022] CAT 24). 

On 27 October 2022 the Tribunal issued its Ruling in respect of the Defendants' application for costs ([2022] CAT 47).
