1338/5/7/20 (T) Adnams PLC and Others v DAF Trucks Limited and Others
Claim for damages for breach of Article 101 of the Treaty on the Functioning of the European Union (and/or its earlier equivalents); Article 53 of the Agreement on the European Economic Area; and/or Chapter I of the Competition Act 1998 by Adnams PLC and twenty-four other Claimants (together, "the Claimants") against (1) DAF Trucks Limited; (2) DAF Trucks N.V.; (3) DAF Trucks Deutschland GmbH; (4) PACCAR Inc.; (5) PACCAR Financial PLC; (6) MAN SE; (7) MAN Truck and Bus Deutschland GmbH; (8) MAN Truck and Bus UK Limited; (9) MAN Truck and Bus SE; (10) AB Volvo (publ); (11) Volvo Lastvagnar AB; (12) Volvo Group Trucks Central Europe GmbH; (13) Volvo Group UK Limited; (14) Renault Trucks SAS; (15) Renault Trucks Commercials Limited; (16) Daimler AG; (17) Mercedes-Benz Cars UK Limited; (18) Fiat Chrysler Automobiles N.V.; (19) CNH Industrial N.V.; (20) Iveco S.p.A.; (21) Iveco Magirus AG; (22) Iveco Limited; and (23) Leyland Trucks Limited. The Claimants rely, amongst other things, on a decision of the European Commission of 19 July 2016 (Case AT.39824 - Trucks) which was addressed to fifteen of the twenty-three Defendants.
The issues in the proceedings were transferred from the High Court to the Tribunal by consent by order of Deputy Master Bartlett dated 23 August 2019.
On 17 February 2021, the Tribunal was notified that the name of the Eighteenth Defendant has changed from Fiat Chrysler Automobiles N.V. to Stellantis N.V..
By Order of 15 December 2021, TRATON SE was substituted for MAN SE as the Sixth Defendant in the proceedings.
A joint case management conference in the Trucks Second Wave Proceedings took place in the Court of Session, Edinburgh on 19 and 20 October 2023.
