1561/5/7/22 (T) Argyll and Bute Council v VFS Financial Services Limited & Others

Claim for damages by Argyll and Bute Council in respect of alleged infringements of Article 101 of the Treaty on the Functioning of the European Union and/or Article 53 of the Agreement on the European Economic Area and/or the Competition Act 1998.

The claim is made against (1) VFS Financial Services Limited; (2) AB Volvo (publ); (3) Volvo Lastvagnar AB; (4) Renault Trucks SAS; and (5) Volvo Group Trucks Central Europe GmbH (together, the “Defenders”). The Defenders seek contribution or relief against (1) TRATON SE (formerly MAN SE); (2) MAN Truck & Bus SE; (3) MAN Truck & Bus Deutschland GmbH; (4) Daimler AG; (5) Iveco S.p.A.; (6) Iveco Magirus AG; (7) Fiat Chrysler Automobiles N.V.; (8) CNH Industrial N.V.; (9) PACCAR Inc; (10) DAF Trucks N.V.; and (11) DAF Trucks Deutschland GmbH.

The proceedings were transferred from the Court of Session, Edinburgh to the Tribunal by Interlocutor of the Court of Session dated 17 October 2022.

A joint case management conference in the Trucks Second Wave Proceedings took place in the Court of Session, Edinburgh on 19 and 20 October 2023.
