1564/5/7/22 (T) Grahams The Family Dairy (Processing) Limited v CNH Industrial N.V.

Claim for damages by Grahams The Family Dairy (Processing) Limited in respect of alleged infringements of Article 101 of the Treaty on the Functioning of the European Union and/or Article 53 of the Agreement on the European Economic Area and/or the Competition Act 1998.

The claim is made against CNH Industrial N.V. (the “Defender”). The Defender seeks contribution or relief against (1) TRATON SE; (2) MAN Truck & Bus SE; (3) MAN Truck & Bus Deutschland GmbH; (4) Daimler AG; (5) PACCAR Inc; (6) DAF Trucks N.V.; (7) DAF Trucks Deutschland GmbH; (8) AB Volvo (publ); (9) Volvo Lastvagnar AB; (10) Renault Trucks SAS; and (11) Volvo Group Trucks Central Europe GmbH.

The proceedings were transferred from the Court of Session, Edinburgh to the Tribunal by Interlocutor of the Court of Session dated 17 October 2022.

A joint case management conference in the Trucks Second Wave Proceedings took place in the Court of Session, Edinburgh on 19 and 20 October 2023.
