1360/5/7/20 (T) BFS Group Limited & Another v DAF Trucks Limited & Others

Claim for damages for breach of Article 101 of the Treaty on the Functioning of the European Union (and/or its earlier equivalents) and/or Chapter I of the Competition Act 1998 by (1) BFS Group Limited; and (2) HM Group Limited (together, "the Claimants") against (1) DAF Trucks Limited; (2) DAF Trucks N.V.; (3) DAF Trucks Deutschland GmbH; (4) PACCAR Inc; (5) PACCAR Financial plc; (6) Leyland Trucks Limited; (7) Scania (Great Britain) Limited; (8) Scania AB; (9) Scania CV AB; and (10) Scania Deutschland GmbH. The Claimants rely on: (i) a decision of the European Commission of 19 July 2016 (Case AT.39824 - Trucks) which was addressed to (amongst others) Second, Third and Fourth Defendants; and (ii) a decision of the Commission of 27 September 2017 (Case AT.39824 - Trucks) which was addressed to (amongst others) the Eighth, Ninth and Tenth Defendants.

The issues in the proceedings were transferred from the High Court to the Tribunal by consent by order of Master Clark dated 2 March 2020.
